Welcome to Vivek Steels. These comprehensive Terms and Conditions ("Terms", "Agreement", "Terms of Service") govern your access to and relationship with the Vivek Steels website, e-commerce platform, and associated digital properties (collectively, the "Service") operated by Vivek Steels, a registered enterprise headquartered in Rewa, Madhya Pradesh, India ("us", "we", "our", or "the Company"). By accessing, browsing, registering for an account, or making a purchase on our Service, you acknowledge that you have read, understood, and unequivocally agree to be legally bound by these Terms.
Your access to and utilization of the Service is strictly conditioned on your unwavering acceptance of and compliance with these Terms. These Terms apply comprehensively to all visitors, registered users, merchants, vendors, content contributors, and others who access or use the Service. If you disagree with any segment, clause, or provision of these terms, you are expressly prohibited from accessing the Service and must immediately cease any further use.
1.1 Account Creation: To access certain premium features, including purchasing products, tracking orders, and saving wishlists, you may be required to register and create a user account. When you create an account, you mandate that the information provided is accurate, exhaustive, and current at all times. Falsification of data, including providing fraudulent contact numbers or shipping addresses, constitutes a severe breach of these Terms, resulting in the immediate suspension or permanent termination of your account.
1.2 Credential Security: You hold sole and absolute responsibility for safeguarding the confidentiality of your account credentials, including passwords and OTPs (One Time Passwords). This applies whether you authenticate using our native login system or a third-party Single Sign-On (SSO) provider such as Google or Facebook. Vivek Steels will never ask for your password via email or phone. You agree to accept full responsibility for any and all activities, purchases, or data modifications that occur under your account.
1.3 Unauthorized Access: You are legally obligated to notify Vivek Steels immediately upon discovering any breach of security, unauthorized access, or suspicious activity pertaining to your account. The Company reserves the unilateral right to refuse service, terminate accounts, revoke access, or cancel orders at our sole discretion if we detect malicious, automated (bot), or fraudulent activity originating from your account.
2.1 Product Descriptions: Vivek Steels devotes substantial resources to ensure that our catalog of steel crockery, kitchenware, hardware, and home appliances is depicted as accurately as possible. We provide detailed specifications regarding dimensions, steel gauge, wattage, and material composition. However, we do not warrant that product descriptions, high-resolution images, colors, or other content on the Service are entirely error-free, current, or complete. Variations in screen calibration may slightly alter the perceived color of metallic and painted products.
2.2 Pricing Fluctuations: The retail prices for our products are subject to dynamic changes without prior notice. Global steel commodity prices, logistical costs, and manufacturer revisions may necessitate sudden price adjustments. The price applicable to your order will be the price explicitly displayed at the exact moment of your checkout.
2.3 Typographical Errors: In the rare event a product is listed at a blatantly incorrect price due to a typographical, systematic, or supplier error, Vivek Steels retains the absolute right to refuse or unilaterally cancel any orders placed for that item. If your credit card, UPI, or bank account has already been charged for the purchase and your order is canceled, we shall immediately initiate a 100% refund back to the original method of payment.
3.1 Order Confirmation: The receipt of an electronic order confirmation (via email or SMS) merely acknowledges that we have received your request; it does not signify our acceptance of your order, nor does it constitute a binding contract to sell. Vivek Steels reserves the right at any time after receiving your order to accept or decline it for any reason.
3.2 Inventory Limitations: We reserve the right to limit the quantities of items purchased per person, per household, or per order. These restrictions may be applied to orders placed by the same user account, utilizing the same credit card, or utilizing identical billing and shipping addresses. In cases where we must cancel an order due to stock depletion, you will be notified and fully refunded.
3.3 B2B and Bulk Orders: This Service is primarily intended for B2C (Business to Consumer) retail. Wholesale or bulk B2B purchases intended for immediate resale without our explicit consent are prohibited and may be canceled. For legitimate bulk purchases, please contact our wholesale division directly.
4.1 Dispatch Timelines: We strive to dispatch all in-stock appliances and cookware within 24 to 48 business hours. However, shipping and delivery dates provided by the Service are estimates strictly provided by our third-party logistics partners (e.g., BlueDart, Delhivery) and are not guaranteed delivery dates.
4.2 Risk of Loss: All items purchased from Vivek Steels are made pursuant to a formal shipment contract. Consequently, the risk of loss, theft, and the title for such items formally pass to you upon our delivery of the package to the designated courier or logistics carrier. In the event of transit damage, you must notify us within 24 hours of delivery, supported by photographic evidence and unboxing videos, to facilitate insurance claims with the carrier.
4.3 Undeliverable Areas: We currently ship across India. However, certain remote pin codes may be unserviceable. If your order falls within an unserviceable zone, we will notify you immediately and process a full refund.
5.1 General Return Policy: Due to the nature of kitchenware and home appliances, we operate a strict 7-day return window solely for products that are delivered in a defective, non-functional, or significantly damaged condition. To be eligible for a return, the item must be completely unused, unaltered, and enclosed in its original, undamaged packaging, complete with all manuals, tags, and warranty cards.
5.2 Non-Returnable Goods: For stringent hygiene protocols, specific items including opened cutlery, used dinner sets, and certain electrical consumables cannot be returned unless they suffer from a verified manufacturing defect present upon unboxing.
5.3 Warranty Claims: Vivek Steels functions as a distinguished retail distributor. Most heavy appliances (mixers, stoves, cookers) sold through our platform carry standard manufacturer warranties. Vivek Steels explicitly disclaims any independent or extended warranty beyond what the manufacturer provides. All technical faults, part replacements, or post-purchase servicing must be directed to the authorized service centers of the respective brand, utilizing the stamped warranty card provided with your purchase.
6.1 Ownership: The entirety of the Service, encompassing its original textual content, high-fidelity graphics, user interfaces, visual interfaces, proprietary code, audio, video, software, and overarching design architecture (the "Content"), is the exclusive, intellectual property of Vivek Steels and its designated licensors.
6.2 Legal Protection: The Service is comprehensively protected by Indian copyright laws, trademark laws, patent laws, and international intellectual property treaties. Our registered trade names, logos, branding, and trade dress may not be utilized, replicated, reverse-engineered, or exploited in connection with any external product or service without the express, verifiable, written consent of the executive board of Vivek Steels.
By engaging with our Service, you explicitly agree NOT to engage in the following prohibited activities:
8.1 Disclaimer of Damages: To the absolute maximum extent permitted by applicable Indian law, in no event shall Vivek Steels, its founders, directors, employees, corporate affiliates, logistics agents, or suppliers be held liable for any indirect, incidental, punitive, special, or consequential damages.
8.2 Scope of Liability: This encompasses, but is not limited to, damages for loss of profits, loss of revenue, loss of goodwill, loss of data, replacement costs, or other intangible losses resulting from: (i) your utilization of or your inability to utilize the Service; (ii) any unauthorized access to or alteration of your personal transmissions or sensitive data; (iii) statements, conduct, or actions of any third party on the Service; or (iv) any physical injury or property damage resulting from the misuse or malfunction of an appliance purchased from our store, where the liability strictly resides with the original manufacturer.
You agree to fully indemnify, defend, and hold harmless Vivek Steels, its subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, and employees, from any claim or demand, including reasonable, standard attorneys' fees, asserted by any third party due to or arising out of your blatant breach of these Terms and Conditions, your violation of any law, or your infringement of the rights of a third party.
10.1 Applicable Law: These Terms and your general usage of the Service shall be governed by, construed, and enforced strictly in accordance with the substantive laws of the Republic of India, completely excluding its conflict of law principles.
10.2 Exclusive Jurisdiction: You irrevocably consent and submit that any legal action, dispute, or proceeding arising out of or relating to these Terms, the Privacy Policy, or your purchases shall be filed and adjudicated exclusively in the competent state or federal courts located within the jurisdiction of Rewa, Madhya Pradesh, India.
10.3 Arbitration: At our sole discretion, we may require you to submit any disputes arising from the use of these Terms of Service or the Service to final and binding arbitration under the Arbitration and Conciliation Act, 1996, taking place in Rewa, Madhya Pradesh.
If any provision, clause, or subsection of these Terms is determined by a court of competent jurisdiction to be invalid, illegal, or legally unenforceable, such provision shall be eliminated or limited to the minimum extent necessary such that the remaining provisions of the Terms will continue in full force and effect. The failure of Vivek Steels to enforce any specific right or provision of these Terms will not be construed or interpreted as a waiver of those rights.
We reserve the unilateral and absolute right to update, modify, or replace these Terms at any time without prior individual notification. We will post the most current version of the Terms on this page, indicated by the "Last Updated" date at the top. It remains your persistent responsibility to review this page periodically for changes. Your continued use of or access to the website following the posting of any significant changes constitutes acceptance of those changes.
